Model Weights Approach the Customs Desk

China plans to tighten export controls on 23 key AI technologies, including model weights, source code and training methods for systems reaching 10^26 FLOPs or 2 trillion parameters. The proposal includes a fast track clearing open-source releases upon registration, placing openness and export administration in the same policy frame. The distinction matters for developers who treat a downloadable model as a straightforward technical resource. Release decisions can also involve national rules about which capabilities and materials may cross borders, even when the border is crossed by a file rather than a shipping container. Software has long enjoyed the physical convenience of having no crate. Policy can still insist that the invisible crate has paperwork. The practical questions concern classification, registration and how release processes fit the planned controls. A fast track eases one route without making the broader framework irrelevant. Developers need to distinguish what a model can do from the administrative category it occupies. The result is another reminder that open weights are not outside the world’s institutions. They can be copied, evaluated and adapted, but they also sit inside commercial and political systems. The future may be downloadable; that does not guarantee it will arrive without a declaration form and a carefully selected dropdown.
